Please read these terms carefully before using the BorrowMe platform.

1. Acceptance of Terms
By accessing or using the services provided by BorrowMe ("Service" or "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access or use the Service.
2. Description of Service
BorrowMe provides a peer-to-peer platform for users to borrow and lend personal items within their community. Our Service facilitates connections between lenders (item owners) and borrowers, enabling them to arrange rentals directly. BorrowMe acts as an intermediary platform and is not a party to the rental agreements between users.
3. User Registration and Account Security
3.1. To use certain features of the Service, you may be required to create an account and complete our verification process. You agree to provide accurate, current, and complete information during the registration process.
3.2. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
3.3. You must immediately notify BorrowMe of any unauthorized use of your account or any other breach of security.
3.4. You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service.
4. Use of the Service
4.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.
4.2. You shall not:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Violate any applicable laws or regulations
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
- Use the Service for sending unsolicited communications, promotions, advertisements, or spam
- Harass, abuse, or harm another person or entity
- Use the Service in any way that could damage, disable, overburden, or impair the Service
- List prohibited, illegal, or dangerous items
5. Prohibited Items
The following items are strictly prohibited from being listed or rented on BorrowMe:
- Weapons, firearms, or explosives
- Illegal drugs or controlled substances
- Stolen property
- Counterfeit or pirated goods
- Hazardous materials
- Items that infringe on intellectual property rights
- Adult content or materials
- Any items prohibited by local, state, or federal law
Violation of this policy may result in immediate account termination and may be reported to law enforcement.
6. Listings and Transactions
6.1. Lenders are responsible for the accuracy of their listings, including descriptions, photos, availability, and pricing.
6.2. Lenders must ensure items are in safe, working condition and match their listing descriptions.
6.3. Borrowers must return items in the same condition as received, subject to normal wear and tear.
6.4. Both parties agree to communicate honestly and complete transactions in good faith.
6.5. BorrowMe reserves the right to remove any listings that violate these Terms or our community guidelines.
7. Item Condition and Returns
7.1. Borrowers must inspect items upon receipt and report any pre-existing damage within 24 hours.
7.2. Items must be returned by the agreed-upon date and time. Late returns may incur additional charges at the daily rate.
7.3. If an item is damaged during the rental period, the borrower is responsible for repair costs or replacement value, subject to our Protection Program terms.
7.4. Failure to return an item within 48 hours of the due date without communication may be considered theft and reported to authorities.
8. Fees and Payment
8.1. All payments are processed through our secure payment system. BorrowMe charges service fees on transactions as disclosed at the time of booking.
8.2. All fees are exclusive of applicable taxes, which you are responsible for paying.
8.3. We reserve the right to change our fees at any time upon notice to you.
8.4. Refunds are subject to our cancellation policy:
- Full refund if cancelled more than 24 hours before the rental start time
- 50% refund if cancelled within 24 hours of the rental start time
- No refund for no-shows or cancellations after the rental period begins
9. Protection and Insurance
9.1. BorrowMe offers protection programs for eligible items and transactions. Coverage is subject to specific terms and conditions.
9.2. Protection coverage may require:
- Verified user accounts
- Accurate item descriptions and photos
- Timely reporting of damage (within 24 hours of return)
- Cooperation with investigation if required
9.3. Users may be required to pay deductibles for claims. Protection does not cover intentional damage, theft by the lender, or items used in violation of these Terms.
10. Communications
10.1. Users must communicate through our in-app messaging system for all rental-related discussions.
10.2. You agree to receive transactional communications related to your rentals, including confirmations, reminders, and status updates.
10.3. Harassment, threats, or abusive communication toward other users is strictly prohibited and may result in immediate account termination.
11. Intellectual Property Rights
11.1. The Service and its original content, features, and functionality are and will remain the exclusive property of BorrowMe and its licensors.
11.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purposes.
11.3. By submitting content (listings, reviews, photos), you grant BorrowMe a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content in connection with providing the Service.
12. Privacy and Data Protection
12.1. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12.2. You agree that BorrowMe may process your personal data in accordance with the Privacy Policy and for the purposes of providing and improving the Service.
13. Disclaimers
13.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
13.2. BorrowMe does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
13.3. We do not guarantee the quality, safety, or legality of items listed, the accuracy of listings, or the ability of users to complete transactions.
13.4. BorrowMe is not responsible for the actions or conduct of any user on or off the platform.
14. Limitation of Liability
14.1. To the maximum extent permitted by law, BorrowMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
14.2. In no event shall BorrowMe's total liability to you for all damages exceed the amount you paid to BorrowMe, if any, in the past twelve months, or $100, whichever is greater.
15. Indemnification
You agree to indemnify and hold harmless BorrowMe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.
16. Termination
16.1. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
16.2. Upon termination, your right to use the Service will immediately cease.
16.3. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco, California.
18. Dispute Resolution
18.1. In the event of a dispute between users, BorrowMe may, at its discretion, mediate the dispute but is not obligated to do so.
18.2. For disputes with BorrowMe, you agree to first attempt to resolve the dispute informally by contacting us.
18.3. Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
19. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
20. Severability and Entire Agreement
20.1. If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
20.2. These Terms constitute the entire agreement between you and BorrowMe regarding the Service and supersede all prior agreements and understandings, whether written or oral.
